Internal Revenue Code (IRC) Section 1031 provides for the deferral of capital gains tax which would ordinarily arise from the sale of real estate. Exchanging defers the realization of the capital gains tax, leaving the property owner with potentially more proceeds with which to purchase a replacement property. The tax code states, “No gain or loss shall be recognized on the exchange of property held for productive use in a trade or business, or for productive use in trade or business or for investment purposes.” Real estate investors may accomplish greater leverage, diversification, improved cash flow, geographic relocation, or property consolidation. Although there are no assurances that any or all objectives will be achieved.


HOW DOES A 1031 TAX EXCHANGE WORK?


A 1031 Exchange is a three-way exchange in which an intermediary, usually a title company or escrow agent, is used to facilitate the transaction.
